Terms of Service

1.Provider and scope

1. 1.1Pennaway (pennaway.com) is operated by the provider named in the legal notice (Impressum).
2. 1.2These terms apply to every use of Pennaway, with or without an account, and to every purchase of credits.
3. 1.3Pennaway is intended for consumers who use it for their own applications.

2.What Pennaway does

1. 2.1Pennaway creates drafts of motivation letters, statements of purpose and personal statements with an AI model, based on the information you enter or upload.
2. 2.2You can write a letter without an account. To read the full letter and save it, you need an account.
3. 2.3Your first full letter is free — one free letter per email address. Further letters are unlocked with credits.
4. 2.4Additional features, such as adapting a letter to another program, notes in the margin or follow-up questions, are part of the service and may change over time.

3.Account and minimum age

1. 3.1You must be at least 16 years old to use Pennaway. If you are younger, you may only use it with the consent of a parent or guardian.
2. 3.2Please provide a valid email address and keep your login details to yourself. You are responsible for activity in your account.
3. 3.3Each person may have one account. Creating several accounts to obtain additional free letters is not allowed.

4.AI-generated drafts and your responsibility

1. 4.1Every letter is a draft generated by artificial intelligence. It may contain mistakes or wording that does not fit you.
2. 4.2You are responsible for checking the draft, correcting it and deciding whether and how you use it.
3. 4.3Some universities restrict or require disclosure of AI tools in applications. Please check the rules of each university you apply to.
4. 4.4We do not guarantee admission or any other outcome of your application.

5.Acceptable use

1. 5.1Only enter information that is true and that you are entitled to use — for example, do not upload other people's CVs without their permission.
2. 5.2Do not use Pennaway to create content unrelated to applications, to circumvent technical limits, to overload the service or to harm others.
3. 5.3We may limit or suspend accounts that misuse the service. Where possible, we will tell you first.

6.Credits, prices and payment

1. 6.1One credit unlocks one full letter. Credits are sold in packages; the prices are shown before you pay and are final prices.
2. 6.2Payment is processed by Stripe. We never see your card details.
3. 6.3Credits are added to your account as soon as the payment is confirmed. If a generation fails for technical reasons, no credit is used.
4. 6.4Credits do not expire while your account exists. They are personal, cannot be transferred and cannot be exchanged for cash, except for refunds under our refund policy.
5. 6.5If you delete your account, unused credits expire. Before deleting, you can still request a refund under our refund policy.

7.Right of withdrawal

As a consumer you have a statutory right of withdrawal. The details, including when it expires early for digital content, are set out in our Refunds & Right of Withdrawal page.

8.Your content

1. 8.1The information you enter and the letters generated for you belong to you. You may use your letters freely.
2. 8.2You allow us to process your content only as far as necessary to provide the service — for example, to send it to the AI model and to store it in your account.
3. 8.3We do not use your content to train AI models, and our AI provider does not use it for training either.

9.Availability and changes to the service

1. 9.1We aim to keep Pennaway available at all times but cannot guarantee uninterrupted operation, for example during maintenance or outages of our providers.
2. 9.2We may develop the service further. We will not remove paid features you have already bought credits for without offering a fair alternative or a refund.

10.Liability

1. 10.1We are liable without limitation for intent and gross negligence, for injury to life, body or health, and under the German Product Liability Act.
2. 10.2For slight negligence we are liable only for breaches of essential contractual obligations — obligations whose fulfilment makes the contract possible and on which you may rely — limited to the typical, foreseeable damage.
3. 10.3Otherwise our liability is excluded. Statutory warranty rights for digital products remain unaffected.

11.Ending the contract

1. 11.1You can stop using Pennaway and delete your account at any time in the account panel.
2. 11.2We may terminate the use of the service for good cause, in particular for serious or repeated misuse.

12.Changes to these terms

1. 12.1The version shown here at the time of your purchase applies to that purchase.
2. 12.2If we change these terms for registered users, we will inform you by email in advance. If you do not agree, you can delete your account; unused credits can be refunded on request.

13.Applicable law and disputes

1. 13.1German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, the mandatory consumer protection rules of the country where you live remain applicable.
2. 13.2We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board. Please contact us directly at hello@pennaway.com — we will try to find a solution.
